Please read these Terms of Service ("Terms") carefully before using the website located at www.armouredfilms.ca (the "Site") or engaging any services offered by 2765411 ALBERTA INC. operating as Armoured Films ("Armoured Films", "we", "us", or "our"). By accessing the Site, submitting a quote request, or booking our services, you ("Client", "you") agree to be bound by these Terms. If you do not agree, do not use the Site or our services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Armoured Films. By placing a booking, submitting a deposit, or using any service offered by Armoured Films, you confirm that you are at least 18 years of age, have the legal capacity to enter contracts in the Province of Alberta, and agree to comply with these Terms. These Terms apply to all services, whether booked online, by phone, or by email.

2. Services Offered

Armoured Films provides professional film installation services including but not limited to:

  • Automotive window tinting (carbon and ceramic film)
  • Paint Protection Film (PPF) installation
  • Residential window film installation
  • Commercial and architectural window film installation
  • Fleet window tinting
  • Related automotive and architectural protective film services as offered from time to time

All services are subject to availability. Armoured Films reserves the right to decline service at its sole discretion. Service descriptions, specifications, and pricing are subject to change without notice, though any changes will not affect confirmed bookings at the price agreed at the time of booking.

3. Booking & Scheduling

The booking process for automotive and valet services proceeds as follows:

  1. Online Quote: Client generates an instant quote through our online tool by selecting vehicle type, film type, and coverage.
  2. Deposit: A non-refundable (subject to the Cancellation Policy) deposit of 20% of the quoted total is required to confirm the booking. Bookings are not confirmed until deposit payment is received.
  3. Booking Confirmation: Upon receipt of deposit, a confirmation email is sent to the address on file with appointment details and instructions.
  4. Valet Pickup: At the scheduled time, Armoured Films dispatches a technician or driver to collect the vehicle from the Client's specified address within the service area.
  5. Installation: Film is installed at our facility by trained technicians using professional tools and techniques.
  6. Delivery: The vehicle is returned to the Client's address upon completion, together with care instructions and warranty documentation.

Estimated completion times are provided in good faith but are not guaranteed. Armoured Films will notify the Client promptly of any material delays.

4. Payment Terms

  • Deposit: 20% of the quoted total, collected at time of booking to confirm the appointment.
  • Balance: The remaining balance is due at or before the scheduled appointment. Payment may be made via the Client portal balance payment page or collected at delivery.
  • Accepted Payment Methods: Visa, Mastercard, and American Express via Square Inc.; cash; and Interac e-Transfer to contact@armouredfilms.ca.
  • Currency: All prices are in Canadian Dollars (CAD) and are exclusive of applicable taxes.
  • GST: Goods and Services Tax (GST) at the rate of 5% is applied to all services in accordance with the Excise Tax Act (Canada). GST will be shown separately on your receipt.
  • Late Payment: Armoured Films reserves the right to withhold delivery of the vehicle until full payment is received.

5. Valet Service Terms

  • Service Area: Valet pickup and delivery is available within Calgary and select surrounding communities including Airdrie, Cochrane, Chestermere, Okotoks, and Springbank. Service area is subject to change. Clients outside the service area may be required to deliver and collect their vehicle directly.
  • Vehicle Accessibility: The Client must ensure the vehicle is accessible and available at the scheduled pickup time and location. If the vehicle is inaccessible at pickup, additional scheduling fees may apply.
  • Keys and Security: The Client is responsible for providing keys or access required to operate the vehicle. Armoured Films will take reasonable care of the vehicle while in our possession.
  • Insurance: Armoured Films carries commercial general liability insurance covering the vehicle while it is in our custody and during transit to and from our facility. The Client should maintain their own insurance on the vehicle at all times.

6. Vehicle Condition Disclosure

Armoured Films documents the pre-existing condition of each vehicle at the time of pickup, including visible scratches, chips, dents, or other damage. By confirming a booking, the Client acknowledges that any pre-existing damage noted at pickup was present before the vehicle came into our custody and was not caused by Armoured Films. A condition report is provided to the Client at pickup and returned with the vehicle. Clients are encouraged to review the condition report and raise any discrepancies before the vehicle is released.

7. Client Responsibilities

  • Provide accurate vehicle information, contact details, and pickup address at the time of booking
  • Ensure the vehicle is available and accessible at the scheduled pickup time
  • Review and comply with all post-installation care instructions, including:
    • Not rolling down windows for a minimum of five (5) days following tint installation
    • Using only ammonia-free cleaning products on tinted windows
    • Avoiding automated brush-type car washes on tinted windows
  • Notify Armoured Films of any concerns or issues within the warranty claim periods specified in the Warranty Policy

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, photographs, videos, and software, is the property of 2765411 ALBERTA INC. or its licensors and is protected by applicable Canadian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works of any Site content without our express prior written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Armoured Films is not liable for pre-existing damage to the vehicle that was present at the time of pickup and noted on the condition report.
  • Armoured Films is not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or these Terms, including loss of use, loss of revenue, or diminution in vehicle value.
  • In all cases, Armoured Films' total liability to the Client arising from any claim related to our services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
  • Armoured Films makes no warranties, express or implied, beyond those explicitly stated in our Warranty Policy.

10. Indemnification

You agree to indemnify, defend, and hold harmless Armoured Films and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your provision of inaccurate or incomplete information; (c) your failure to comply with post-installation care instructions resulting in damage or warranty claims; or (d) your violation of any applicable law.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

12. Dispute Resolution

In the event of a dispute arising out of or relating to these Terms or our services, the parties agree to first attempt resolution through good-faith negotiation by contacting Armoured Films at contact@armouredfilms.ca. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the matter to the courts of the Province of Alberta, which shall have exclusive jurisdiction. You irrevocably submit to the personal jurisdiction of those courts.
